Patna High Court

Sarswati Devi @ Saraswati DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner under the applicable provisions of the Bharatiya Nyaya Sanhita.

Summary

The petitioner, Sarswati Devi, was arrested in connection with a dowry‑related murder alleged to have occurred on 18‑06‑2025, where the deceased’s sister‑in‑law was allegedly strangulated. She contended that she has a clean antecedent, is a woman, and was falsely implicated by the informant, who is not an eyewitness and offered only vague allegations of dowry demand. The petition sought bail under Sections 80 and 3(5) of the Bharatiya Nyaya Sanhita, arguing that she would not abscond and would cooperate with the trial. The State opposed the bail, emphasizing the seriousness of the offence. The Court, after considering the petitioner's clean record and the lack of substantive evidence, ordered her release on bail upon furnishing a bond of Rs.10,000 with two sureties. The order disposes of the bail application in favour of the petitioner.

                   4. Learned counsel for the petitioner submits that

petitioner has been falsely implicated in the instant case by the

and as far as allegation of demand of dowry and torture is
