Holding

The court held that a petitioner is entitled to withdraw his anticipatory bail application, and upon such withdrawal the application stands dismissed.

Summary

Golu Kumar filed an anticipatory bail application in connection with a case registered under multiple offences of the B.N.S., 2023 and the Public Property Damage Act. While the application was pending, the petitioner sought permission to withdraw it so that he could pursue a regular bail remedy. The court entertained the petitioner's request and granted permission to withdraw the anticipatory bail. Consequently, the anticipatory bail application was dismissed as withdrawn. The court directed that, upon the petitioner's surrender within four weeks, his regular bail application be heard on the same day without prejudice from the earlier order.
