The court granted anticipatory bail to the petitioner subject to bond and surety conditions under Section 482(2) B.N.S.S.
Summary
Petitioner Dilkhush Kumar sought anticipatory bail after being implicated in a case under Sections 137(2), 96, 140(3) and 3(5) of the B.N.S., 2023, alleged to involve the kidnapping of his daughter on 14‑04‑2025. The petitioner argued that he has a clean record, the FIR was lodged 16 days after the alleged incident, and the victim’s statement under Section 183 BNSS did not support the prosecution’s version. The State opposed the bail, contending that the allegations warranted arrest. The court examined the delay, the victim’s statement, and the lack of substantive evidence linking the petitioner to the crime. Finding the petitioner's arguments persuasive and noting the procedural safeguards under Section 482(2) B.N.S.S., the court granted anticipatory bail subject to a bond of Rs.10,000 and two sureties of equal amount. The order was conditioned on the petitioner surrendering within six weeks if arrested.
Issues considered
- Whether anticipatory bail should be granted in view of the alleged kidnapping and the delay in filing the FIR
- Whether the petitioner’s clean antecedent and the victim’s statement negate the necessity of arrest
