The Court allowed the anticipatory bail application, granting provisional bail subject to conditions and verification of the petitioner’s antecedent.

Summary

The petitioner, Sitaram Rai, applied for anticipatory bail under Section 438(2) of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 15 litres of liquor from a location adjacent to his house. The petitioner asserted that he has a clean antecedent, was not arrested at the spot, and that the alleged contraband was not in his conscious possession. The State opposed the anticipatory bail, arguing the seriousness of the offence. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to verification of his antecedent by the trial court. The order further stipulated that if any prior case is discovered, the bail would be revoked, otherwise the provisional bail would be confirmed.

Issues considered

  • Whether anticipatory bail can be granted under Section 438(2) CrPC for an offence punishable under Section 30(a) of the Excise Act.
  • Whether the petitioner’s clean antecedent warrants the grant of anticipatory bail.
  • What conditions should be imposed on the anticipatory bail.
