Patna High Court

Arjun RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed the bail application, directing the petitioner’s release on regular bail with bond and sureties.

Summary

Arjun Rai was arrested in connection with offences under Section 414 of the Indian Penal Code and Section 30(a) of the Excise Act, relating to alleged possession of liquor seized from two motorcycles. The petitioner argued that he was not arrested at the scene, had no conscious possession of the seized items, was not the owner of the motorcycles, and was implicated solely on secret information, despite having three prior cases, two under the Excise Act. He assured the court that he would not abscond and would cooperate with the trial. The State opposed bail. Considering these submissions, the court ordered his release on regular bail upon furnishing a bond of Rs 5,000 with two sureties of the same amount, and the bail application was allowed.

Issues considered

  • Whether bail should be granted to the accused in offences punishable under Section 414 IPC and Section 30(a) Excise Act given the nature of the allegations and his prior criminal record.
