Patna High Court

Indal Chaudhary @ Lotha ChaudharyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, directing release upon furnishing the prescribed bond and sureties.

Summary

The petitioner, Indal Chaudhary, was charged under Section 30(a) of the Excise Act for alleged possession of 22 litres of liquor and large quantities of jawa mahua seized from his residence, which is a joint family property. He was not arrested at the scene and the seized items were not found in his conscious possession. The petitioner argued that the case was based on secret information and that he would not abscond, having been in custody since December 2025. The State opposed bail, but the court noted the lack of direct evidence linking the petitioner to the contraband and the joint ownership of the house. Consequently, the court ordered his release on regular bail upon furnishing a bond of Rs.5,000 with two sureties, and allowed the bail application.

Issues considered

  • Whether the petitioner is entitled to bail in a case under Section 30(a) of the Excise Act given the circumstances of alleged possession and joint family ownership of the property.
