The court granted anticipatory bail to the petitioner subject to bond, sureties and the condition that his brother act as a bailor.
Summary
The petitioner, Julfiquar Khan, was implicated in a FIR alleging assault with an iron pipe, threats to kidnap and marry a 13‑year‑old girl, and other offences under the Bharatiya Nagarik Suraksha Sanhita (BNS) and the POCSO Act. He contended that he has a clean record, that the allegations stem from a personal dispute with the informant, and that he was falsely implicated. The petitioner sought anticipatory bail, arguing that surrendering to the police would not lead to absconding and would allow him to cooperate with the investigation. The State and the informant opposed the bail, citing the seriousness of the offences. After hearing both sides, the court granted anticipatory bail subject to a bond of Rs.25,000, two sureties of equal amount, and the condition that the petitioner’s brother act as one of the bailors. The order was made under Section 438(2) of the CrPC and Section 482(2) of the BNS, with the assurance that the petitioner’s family would ensure his good behaviour. The bail is to be presented before the Special Judge of the POCSO Court in Siwan within four weeks of arrest or surrender.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438 of the CrPC and Section 482 of the BNS given the alleged offences under BNS and the POCSO Act.
