Patna High Court

Saud Alam @ Sawood Alam @ Md Saud AlamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that anticipatory bail should be granted as the petitioner had no constructive possession of the liquor and the motorcycle had been sold prior to the incident.

Summary

Saud Alam applied for anticipatory bail in connection with a case (Sikti P.S. Case No.175 of 2022) where the police alleged that a motorcycle rider abandoned a sack containing illicit liquor after a chase, and the seized motorcycle (BR38B‑3858) and liquor were linked to the petitioner. The petitioner contended that the motorcycle had been sold to Amir Uddin in March 2022 and that he had no possession of the liquor. The prosecution opposed the bail, citing the alleged offence under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018. The court noted the lack of constructive possession of the liquor by the petitioner and the prior transfer of ownership of the vehicle, and therefore inclined to grant anticipatory bail. The court ordered the petitioner to furnish a bail bond of Rs.10,000 with two sureties and released him on anticipatory bail subject to Section 482(2) of the B.N.S.S., 2023.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner despite the alleged offence under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.
  • Whether the petitioner is in constructive possession of the seized illicit liquor and the motorcycle.
