Holding

The Court granted provisional anticipatory bail to the petitioner subject to bail bonds and verification of his antecedent.

Summary

The petitioner, Santosh Singh, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 20 litres of liquor from his tea shop. He asserted a clean antecedent and claimed that the liquor was concealed by others who were apprehended, and that no liquor was found in his possession at the time of arrest. The State opposed the bail. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to the conditions of Section 438(2). The order also stipulated that the trial court verify the petitioner’s antecedent and confirm the bail if he is found to have a clean record, otherwise the bail would not be confirmed. The application for anticipatory bail was allowed.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 CrPC for an offence under Section 30(a) of the Excise Act
  • Whether the petitioner’s claim of a clean antecedent justifies the grant of bail
  • Whether the conditions imposed under Section 438(2) are appropriate in the present facts
