The court granted bail to the petitioner, subject to a bond and sureties, under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Summary

The petitioner, Sanjit Kumar Rao, sought bail in a criminal case registered under Section 7 of the Essential Commodities Act for alleged shortfall of 421.58 quintals of foodgrains during a PDS shop inspection. He contended that the FIR was lodged after a five‑year delay without proper verification and that he had no criminal antecedents or consumer complaints of black‑marketing. The petitioner also highlighted that his PDS licence had been cancelled and he had filed an appeal against that cancellation before the District Magistrate. The State opposed the bail application. Considering the delay in filing the FIR, the petitioner’s clean record, and the nature of the allegation, the court granted bail subject to a bond of Rs.10,000 with two sureties and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Issues considered

  • Whether bail should be granted in a case under Section 7 of the Essential Commodities Act given the delay in lodging the FIR
  • Whether the petitioner’s clean antecedent and lack of evidence of black‑marketing justify bail
  • Whether Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita permits the court to release the petitioner on bail
