The Court granted provisional anticipatory bail to the petitioner, subject to bail bonds and verification of his antecedent.
Summary
The petitioner, Maneger Yadav, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of two litres of liquor from a sack concealed near his house. The petitioner asserted a clean criminal record and argued that the alleged liquor was not in his conscious possession and that the complaint was motivated by an inimical relationship with the complainant watchman. The State opposed the anticipatory bail. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to the conditions of Section 438(2) CrPC. The order also stipulated verification of the petitioner’s antecedent by the trial court, with confirmation of bail if the antecedent is clean, and cancellation if any prior case is discovered.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC in a case under Section 30(a) of the Excise Act.
- Whether the petitioner’s alleged involvement in the alleged liquor recovery warrants denial of bail.
- Whether the petitioner’s criminal antecedent is clean and relevant to the grant of anticipatory bail.

accepting the provisional bail bonds of the petitioner shall verify
the criminal antecedent of the petitioner and in the event, if it is
