Chandan Kumar RamversusThe State of Bihar

Holding

Provisional anticipatory bail was granted subject to bail bond, sureties and verification of the petitioner’s antecedent.

Summary

Chandan Kumar Ram was implicated in a case under IPC sections 272, 273 and 34, read with Bihar Excise Act sections 30(a) and 41, for allegedly possessing 1.5 litres of liquor recovered from his motorcycle. He contended that he had a clean antecedent, was not in actual possession at the time of seizure, and that his brother had misused the vehicle without his knowledge. The State opposed his prayer for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.500 with two sureties and that the trial court verify his criminal antecedent within six weeks. If any antecedent is discovered, the bail would be cancelled; otherwise, the provisional order would be confirmed.

Issues considered

  • Whether anticipatory bail can be granted in a case involving alleged possession of illicit liquor under the IPC and Bihar Excise Act.
  • Whether the petitioner’s lack of actual possession and clean antecedent justify the grant of anticipatory bail.
  • Whether the trial court must verify the petitioner’s criminal antecedent before confirming the bail.
