Holding
The Court granted provisional anticipatory bail to the petitioner subject to bail bond, sureties and verification of his criminal antecedent, with confirmation contingent on the outcome of that verification.
Summary
The petitioner, Chandan Safi, sought anticipatory bail fearing arrest in a case registered under Sections 274, 275 and 3(5) of the Bihar Narcotic Substances Act and Section 30(a) of the Bihar Excise Act, alleging that the alleged liquor recovery was from a bamboo orchard belonging to another person and that he had no possession or involvement. He contended that the FIR was based on secret information and that the police had mechanically implicated him without proper investigation. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.10,000 with two sureties and that the trial court verify his criminal antecedent. If more than two prior cases are found, the bail will not be confirmed; if only two are found, the provisional order will be confirmed. The order is made under Section 482(2) of the Bihar Narcotic Substances Act.
Issues considered
- Whether anticipatory bail is appropriate when the alleged contraband was not found in the accused's possession.
- Whether reliance on secret information in the FIR suffices to deny anticipatory bail.
- Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.
- Whether conditions under Section 482(2) of the Bihar Narcotic Substances Act can be imposed on anticipatory bail.
