Noor AlamversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner subject to conditions under Section 482(2) of the BNSS.

Summary

Petitioner Noor Alam sought anticipatory bail fearing arrest in a case registered under multiple sections of the Bharatiya Nyaya Sanhita relating to alleged extortion, assault and other offences arising from a land dispute. The informant alleged that a group, including the petitioner, had constructed a house on disputed land, demanded Rs. 5 lakh, and assaulted the informant’s sister with a sword, among other crimes. The petitioner contended that the allegations against him were vague and that he was falsely implicated. The State opposed the bail application. The court examined the FIR and the nature of the allegations and, applying Section 482(2) of the BNSS, granted anticipatory bail with a bond of Rs. 10,000 and two sureties, subject to conditions, for a period of six weeks.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the Bharatiya Nyaya Sanhita in view of the alleged offences.
  • Whether the allegations against the petitioner are specific enough to deny bail.
