The Court allowed the anticipatory bail application, granting provisional bail subject to conditions under Section 438(2) of the Cr.P.C.

Summary

The petitioner, Rampukar Rai, applied for anticipatory bail in a case registered under Sections 274 and 275 of the Bihar Narcotic Substances Act and Section 30(a) of the Excise Act, alleging recovery of 80 litres of liquor from a motorcycle. He claimed he was not arrested on the spot, had no conscious possession of the seized vehicle, and was implicated by a watchman with whom he had a hostile relationship. The State opposed the bail, citing the petitioner’s antecedent of four prior Excise cases. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a Rs.20,000 bail bond, two sureties, and compliance with Section 438(2) of the Cr.P.C., directing the trial court to verify the petitioner’s criminal antecedent. The order stipulated that if more than four prior cases are found, the bail would be revoked; otherwise, it would be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the alleged offences under the Bihar Narcotic Substances Act and Excise Act.
  • Whether the petitioner’s prior criminal antecedent of four Excise cases warrants denial of anticipatory bail.
  • Whether the petitioner is likely to tamper with evidence or abscond if released on bail.
