Patna High Court

Satendra YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioners subject to the conditions specified.

Summary

Satendra Yadav and Ritesh Kumar, owner and driver of a tractor, were implicated in illegal sand‑mining and charged under Sections 303(2) and 317(2) of the Bharatiya Nyaya Sanhita. The petitioners feared arrest and applied for anticipatory bail, asserting that they had already paid a fine of Rs 38,845 and possessed a clean antecedent. The State opposed the bail application. The court noted the payment of the fine and the petitioners’ clean record, and considered the statutory provision under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita. Accordingly, the court granted anticipatory bail, directing the petitioners to furnish a bail‑bond of Rs 10,000 each with two sureties if arrested within eight weeks. The order is subject to the conditions laid down by the Additional Sessions Judge, Danapur.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners despite the pending charges under the Bharatiya Nyaya Sanhita.
  • Whether the payment of the fine and the claim of a clean antecedent justify the grant of bail under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.
