The court allowed the anticipatory bail application, granting provisional bail subject to conditions and verification of antecedents.

Summary

Petitioner Rajkumar applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case under Section 30(a) of the Excise Act, alleging recovery of liquor from his shop and a motorcycle. He contended that he was not in possession of the seized liquor, was not the owner of the vehicle, and was possibly framed by an adversary. The State opposed the bail. The High Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to verification of his criminal antecedents. The court stipulated that if more than two prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed. The application was allowed.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 CrPC for offences under Section 30(a) of the Excise Act
  • Whether the petitioner’s alleged lack of possession and ownership of the seized liquor and vehicle justifies anticipatory bail
  • Whether the petitioner’s criminal antecedent of two prior cases affects the grant of anticipatory bail

                                3. The learned counsel for the petitioner submits that

would create evidence against himself and hence, would get

implicated and at the same time shall bring disrepute to his

inimical to the petitioner concealed meager amount of liquor

with an intent to implicate the petitioner in the instant case.

                       5. Learned A.P.P. Sri Chandra Bhushan Prasad

          opposes the anticipatory bail application.

                       6. Considering the submissions made by the learned

found that petitioner has antecedent of more than two cases,

then it would be presumed that petitioner for the purposes of
