Provisional anticipatory bail is granted subject to Section 438(2) CrPC conditions and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Dhiraj Kumar, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with alleged offences under Section 317(5) of the Bihar Narcotic Substances Act and Section 30(a) of the Excise Act. He has five prior criminal cases, one involving the alleged recovery of 112 litres of liquor from a scooty, and claims he was not arrested at the spot and no contraband was found in his possession. The State opposed the bail, arguing the seriousness of the offences and the petitioner’s antecedents. The Court, after hearing both sides, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs 25,000 with two sureties, subject to the conditions of Section 438(2) CrPC. The Court also ordered the trial court to verify the petitioner’s criminal antecedent and stipulated that if more than five prior cases are found, the bail would not be confirmed. The application was allowed, granting provisional anticipatory bail pending verification.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner despite his antecedent of five criminal cases.
  • Whether the nature of the alleged offences under the Bihar Narcotic Substances Act and the Excise Act warrants denial of bail.

the seized scooty and he came to be implicated based on secret

information, which is the easiest way to implicate someone

without holding a proper investigation. It is further submitted

that off late the police has started implicating accused with

criminal antecedent in cases relating to excise for obvious

found that petitioner has antecedent of more than five cases,

then it would be presumed that petitioner for the purposes of

obtaining anticipatory bail had concealed his antecedent before
