The Court allowed the anticipatory bail application, granting provisional bail subject to verification of the petitioner’s antecedent.

Summary

The petitioner, Indal Kumar, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged possession of 4.875 litres of liquor. He asserted that he has a clean antecedent and that the alleged liquor was recovered from another individual, Chandan Kumar, whose confession in police custody lacks evidentiary value. The State opposed the bail, arguing the seriousness of the offence. The Court, after considering the submissions, directed the petitioner to be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to verification of his criminal antecedent. The order further stipulated that if any antecedent is discovered, the bail would not be confirmed, whereas a clean record would lead to immediate confirmation of the bail.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 CrPC in a case under Section 30(a) of the Excise Act.
  • Whether the confession of the co-accused, made in police custody, can be relied upon to justify denial of bail.
