Patna High Court

Kailu Kumar @ Bittu KumarversusThe State of Bihar

Holding

The court allowed the anticipatory bail application, granting provisional bail subject to bond, sureties and verification of antecedents.

Summary

Kailu Kumar applied for anticipatory bail anticipating arrest in a case under Sections 30(a) and 32 of the Excise Act. He argued that he was not in possession of the seized motorcycle and that the case against him relied solely on a confessional statement of Gaurav Kumar made in police custody, which he claimed lacked evidentiary value. The State opposed the bail. The Patna High Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs 10,000 with two sureties, subject to the conditions of Section 438(2) of the Cr.P.C. The court also ordered verification of the petitioner’s criminal antecedent, stating that if more than two prior cases are found, the bail may be withdrawn. The application for anticipatory bail was allowed.

Issues considered

  • Whether anticipatory bail can be granted when the alleged offence under the Excise Act is based solely on a co‑accused’s confessional statement.
  • Whether the petitioner’s lack of possession of the seized property justifies anticipatory bail.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
