The Court granted provisional anticipatory bail to the petitioner subject to bail bonds, sureties and verification of his antecedent.

Summary

The petitioner, Devendra Paswan, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 36 litres of liquor. He argued that he has a clean antecedent, that the liquor was found behind his house and not in his conscious possession, and that the complaint was filed by a hostile watchman. The State opposed the bail. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to verification of his antecedent by the trial court. The order further stipulated that if any prior case is discovered, the bail would be cancelled, otherwise it would be confirmed.

Issues considered

  • Whether anticipatory bail should be granted under Section 438 CrPC in a case under Section 30(a) Excise Act.
  • Whether the petitioner’s lack of conscious possession and clean antecedent justify granting bail.
  • What conditions should be imposed on the provisional anticipatory bail.
