Patna High Court

Ravi Kumar Pandit @ Ravi PrajapativersusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to the conditions specified under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Summary

The petitioner, Ravi Kumar Pandit, was arrested in a case alleging abduction of an informant's daughter for marriage, charged under Sections 137(2) and 87 of the Bharatiya Nyaya Sanhita. The victim, a 25‑year‑old woman, gave a statement under Section 183 of the Bharatiya Nyaya Sanhita stating that she left her house voluntarily and denied any coercion. The petitioner applied for anticipatory bail, asserting a clean antecedent. The State opposed the bail on the ground of the seriousness of the alleged offences. Considering the victim’s voluntary statement, the court granted anticipatory bail, directing the petitioner to surrender within eight weeks and to furnish a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Issues considered

  • Whether anticipatory bail should be granted when the victim’s statement indicates voluntary departure.
  • Whether the offences under Sections 137(2) and 87 of the Bharatiya Nyaya Sanhita preclude anticipatory bail.
  • Whether the conditions prescribed under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita are applicable.
