Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to all petitioners.

Summary

The petitioners, four accused persons, were arrested in connection with the alleged recovery of 514 litres of liquor from a truck, alleged offences under Section 30(a) of the Excise Act. Petitioners No.1, 2 and 3 claimed they had clean antecedents and were merely passengers unaware of the cargo, while petitioner No.4 had a prior Excise case. They argued that the confessional statement of a co-accused, which formed the basis of the charge against No.4, lacked evidentiary value. The State opposed the bail, contending the seriousness of the offence. The Court considered the clean records, the circumstances of apprehension, and the length of custody, and ordered that each petitioner be released on bail upon furnishing a bail bond of Rs.5,000 with two sureties, thereby allowing the application.
