The Court allowed the anticipatory bail application conditionally, subject to bail bonds and verification of antecedents.

Summary

Badal Kumar applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case under Section 30(a) of the Excise Act, alleging recovery of liquor from his house and another residence. He argued that the liquor was not in his conscious possession, the house is joint family property, and the 2018 amendment to the Excise Act has abolished the concept of deemed possession. The State opposed the bail, citing his two prior Excise cases. The Patna High Court granted provisional anticipatory bail on the condition that he furnish a bail bond of Rs.10,000 with two sureties and appear before the trial court within six weeks. The court also directed verification of his criminal antecedents, stating that if more than two prior cases are found, the bail may be revoked, otherwise it will be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC for alleged offences under Section 30(a) of the Excise Act.
  • Whether the amendment removing the concept of deemed possession affects the petitioner’s liability.
  • Whether the petitioner’s prior criminal antecedents disqualify him from obtaining anticipatory bail.

                                 2. The petitioner seeks bail in anticipation of his

arrest in a case registered for the offences punishable under

                                 3. The learned counsel for the petitioner submits that

petitioner was not arrested from the spot, as such, nothing was

with certainty that it was the petitioner, who had kept the liquor

in the house or the liquor kept in the house was within his

knowledge and after Amendment in the Excise Act, 2018, the

concept of deemed possession and presumed offender has been

done away with and he came to be implicated based on secret

information, which is the easiest way to implicate someone

          without holding a proper investigatiion.

                       5. Learned A.P.P. opposes the anticipatory bail

          application.

                       6. Considering the submissions made by the learned

counsel for the petitioner, the petitioner, above-named, in the

event of his arrest or surrender before the learned Court below

within a period of six weeks, is directed to be released on

                       7. The application stands allowed.

                       8. It is made clear that the learned trial Court after

accepting the provisional bail bonds of the petitioner shall verify

the criminal antecedent of the petitioner and in the event, if it is

found that petitioner has antecedent of more than two cases,

then it would be presumed that petitioner for the purposes of

obtaining anticipatory bail had concealed his antecedent before

this Court, in that event, the present provisional anticipatory bail

the provisional anticipatory bail order shall be confirmed

                         forthwith.
