Patna High Court

Ranjan KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The Court dismissed the bail application, refusing bail to the petitioner.

Summary

The petitioner, Ranjan Kumar, applied for regular bail in a case registered as Dhanarua P.S. Case No. 608/2025, where he is accused, along with two others, of gang rape under Sections 4 and 6 of the POCSO Act and Sections 64(1) and 70(2) of the B.N.S. Act. The petitioner claimed he was falsely implicated, that the parties had settled their dispute, and that he had no prior criminal record, having been in custody since 18‑10‑2025 and willing to cooperate with the trial. The State, represented by an Additional Public Prosecutor, opposed the bail on grounds of the seriousness of the alleged offence and alleged tampering with evidence. The Court, after considering these submissions, held that the gravity of the gang‑rape allegation and the risk of evidence tampering warranted denial of bail. Consequently, the bail application was dismissed.

Issues considered

  • Whether bail should be granted to an accused of gang rape under the POCSO Act and B.N.S. Act.
  • Whether alleged tampering with evidence precludes the grant of bail.
  • Whether a settlement between the parties affects the bail decision.

                                4. Learned counsel for the petitioner submits that
