The court held that anticipatory bail may be granted subject to verification of the petitioner’s antecedent and compliance with the conditions prescribed under Section 438(2) of the CrPC.
Summary
The petitioner, Sanu Mahto, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 35 litres of liquor from a bush near his cattle‑shed. He argued that he has a clean antecedent, was not arrested, and the liquor was not found in his conscious possession, contending that the informant, a watchman with whom he has a hostile relationship, should have reported the matter earlier. The State opposed the bail. The High Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to the conditions of Section 438(2) CrPC and verification of his antecedent by the trial court. The order stipulated that if any antecedent is discovered, the bail would be cancelled; otherwise, it would be confirmed. The application was allowed, granting provisional anticipatory bail.
Issues considered
- Whether anticipatory bail can be granted under Section 438 CrPC for an offence punishable under Section 30(a) of the Excise Act.
- Whether the absence of arrest and lack of possession of the alleged liquor affect the grant of anticipatory bail.
- Whether the petitioner’s criminal antecedent, if any, should influence the confirmation of anticipatory bail.
