Holding

The court granted provisional anticipatory bail subject to bond, sureties, and verification of the petitioner’s antecedent.

Summary

The petitioner, Amit Kumar, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case under Section 30(a) of the Excise Act concerning the alleged recovery of 200 litres of liquor from a motorcycle. He asserted that he has a clean antecedent, was not in possession of the seized liquor, and was implicated based on secret information without proper investigation. The State opposed the bail. The High Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs.500 with two sureties, subject to verification of his criminal antecedent. The court clarified that if any antecedent is discovered, the bail would not be confirmed; otherwise, it would be confirmed forthwith. The application for anticipatory bail was allowed.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Excise Act where the petitioner claims no possession and a clean antecedent.
  • Whether reliance on secret information without a proper investigation justifies denial of anticipatory bail.
