Bail was granted to the petitioner subject to a bond of Rs. 10,000, two sureties, surrender within eight weeks, and conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
Summary
Munna Singh applied for bail fearing arrest in a case registered under Sections 318(4) and 61(2) of the Bhartiya Nyaya Sanhita, 2023, after a raid on the alleged Mamta Clinic which was claimed to be operating without registration or licence. The petitioner contended that he is not the owner of the clinic and that no incriminating material was recovered. The State opposed the bail, arguing the seriousness of the alleged offences. The Court, after considering the facts, ordered that the petitioner be released on bail if he surrenders within eight weeks, upon furnishing a bail bond of Rs. 10,000 with two sureties of equal amount, and subject to conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023. The order was pronounced by Justice Prabhat Kumar Singh.
Issues considered
- Whether bail should be granted to the petitioner under the circumstances of the alleged offences under Sections 318(4) and 61(2) of the Bhartiya Nyaya Sanhita, 2023
- Whether the conditions imposed under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 are appropriate
