Holding

The court held that bail should be granted to the petitioner subject to a bond of Rs.10,000 with two sureties and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Summary

Jai Prakash Raman, a 60‑year‑old former teacher, was charged under IPC sections 420, 467, 468, 471 and 120B for allegedly securing a teaching post using forged documents, leading to his termination from service. He pleaded innocence, asserted no prior criminal record, and offered full cooperation with the investigation. The State opposed his bail application. The Patna High Court, after considering the facts, the petitioner’s age, lack of antecedents, and the fact that he had already been terminated, ordered bail on the condition of a Rs.10,000 bond with two sureties, subject to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita. The order directs that bail be granted if the petitioner is arrested or surrenders within six weeks.

Issues considered

  • Whether bail should be granted to the petitioner despite charges of forgery and criminal conspiracy under IPC sections 420, 467, 468, 471 and 120B.
  • Whether the petitioner’s termination from service and alleged use of forged documents preclude the grant of bail.
  • Whether Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita permits the court to impose bail conditions in this case.
