The court allowed the anticipatory bail application, granting provisional bail subject to conditions under Section 438(2) CrPC.
Summary
Vikash Kumar applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case under Section 30(a) of the Excise Act, where 212 litres of liquor were allegedly recovered from three motorcycles. The petitioner argued that he has a clean antecedent, was not arrested at the scene, did not have possession of the seized vehicles, and was implicated solely on a confessional statement made by another accused in police custody, which he claimed lacks evidentiary value. The State opposed the bail. The High Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to verification of his criminal antecedent and other conditions under Section 438(2) CrPC. The court clarified that if any antecedent is discovered, the provisional bail would not be confirmed. The application for anticipatory bail was allowed.
Issues considered
- Whether anticipatory bail can be granted under Section 438 CrPC in a case involving alleged contravention of Section 30(a) of the Excise Act.
- Whether a confessional statement of a co-accused made in police custody can form the basis for denying anticipatory bail.
- Whether the petitioner’s clean antecedent and lack of possession justify granting anticipatory bail.
