The Court allowed the anticipatory bail application, granting provisional bail subject to verification of the petitioner’s antecedent.

Summary

Nipoo Kumari applied for anticipatory bail in a case under Section 30(a) of the Excise Act where 27 litres of liquor were allegedly recovered from a motorcycle she owned. She asserted that she has a clean antecedent, was not in possession of the liquor at the time of seizure, and was unaware that the vehicle would be misused. The State opposed the bail, arguing the vehicle’s ownership linked her to the offence. The Court examined the submissions, noted the lack of direct possession and her clean record, and applied Section 438(2) of the Cr.P.C. to grant provisional anticipatory bail with a bond of Rs.500 and two sureties. The order is subject to verification of her antecedent; if any prior case is found, the bail may be withdrawn, otherwise it will be confirmed.

Issues considered

  • Whether anticipatory bail can be granted when the accused is not in direct possession of the contraband.
  • Whether ownership of the vehicle used in the alleged offence suffices to deny anticipatory bail.
  • What conditions under Section 438(2) of the Cr.P.C. are applicable to the grant of anticipatory bail in this case.
