The court granted provisional anticipatory bail, subject to verification of the petitioner’s antecedent, under Section 438(2) CrPC.

Summary

Munna Singh applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case under Section 30(a) of the Excise Act, alleging recovery of 11 litres of liquor from a motorcycle. The petitioner claimed a clean antecedent, that he was not in possession of the seized motorcycle, and that the complaint was motivated by an inimical relationship with the informant. The State opposed the bail. The High Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to verification of his criminal antecedent. The court stipulated that if any antecedent is discovered, the provisional bail would not be confirmed; otherwise, it would be confirmed. The application was allowed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 CrPC in a case under Section 30(a) of the Excise Act.
  • Whether the petitioner’s alleged clean antecedent and lack of possession of the seized property justify granting anticipatory bail.
