Sujeet Kumar Sah @ Sujeet KumarversusThe State of Bihar

Holding

The Court held that anticipatory bail is appropriate where there is no direct material against the petitioner and he is willing to cooperate, subject to statutory conditions.

Summary

The petitioner, Sujeet Kumar Sah, sought anticipatory bail fearing arrest under Section 30(a) of the Bihar Prohibition & Excise Act for alleged possession of 14.535 litres of foreign liquor recovered from his garden. He contended that he was not present at the scene, that no material was recovered from his possession, and that the only evidence was a confessional statement of a co‑accused. The State opposed the bail, citing the seriousness of the offence and the petitioner’s prior criminal antecedents. The Court, after considering the submissions, held that the lack of direct evidence against the petitioner and his willingness to cooperate warranted the grant of anticipatory bail, subject to conditions. Accordingly, the petitioner was released on bail upon furnishing a bond of Rs. 10,000 with two sureties, under the conditions of Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition & Excise Act.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of anticipatory bail.
  • Whether a confessional statement of a co‑accused alone is sufficient to justify denial of bail.
