Holding

The Court allowed the anticipatory bail, granting provisional bail subject to conditions and verification of antecedents.

Summary

The petitioner, Pintu Ram, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 14 litres of liquor near his house. The petitioner argued that he was not arrested at the spot, no liquor was found in his possession, and the recovery was from adjacent premises based on secret information, suggesting a possible false implication. The State opposed the bail. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.10,000 with two sureties, subject to verification of his criminal antecedent. The order stipulated that if more than two prior cases are found, the bail would not be confirmed; if only two are found, the bail would be confirmed. The application was allowed.

Issues considered

  • Whether anticipatory bail should be granted under Section 438 CrPC to the petitioner accused under Section 30(a) of the Excise Act.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.

he came to be implicated based on secret information, which is

the easiest way to implicate someone. It is next submitted that

found that petitioner has antecedent of more than two cases,

then it would be presumed that petitioner for the purposes of
