Parwati DeviversusThe State of Bihar

Holding

The Court granted provisional anticipatory bail to the petitioner, subject to bail bonds, sureties and verification of her antecedent.

Summary

The petitioner, Parwati Devi, applied for anticipatory bail under Section 438 of the Cr.P.C. in a case alleging recovery of 229.725 litres of liquor from two vehicles, invoking Sections 30(a), 32(ii) and 41(i) of the Excise Act. She argued that she has a clean antecedent, is a woman, and was not in possession of the liquor; the vehicle was owned by her but she was unaware of its misuse. The State opposed the bail, contending possible involvement. The Court considered the submissions, the lack of direct possession, and the petitioner’s clean record, and directed that she be released on provisional anticipatory bail upon furnishing bail bonds and sureties, subject to verification of her antecedent. The order also stipulated that if any antecedent is discovered, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 Cr.P.C. in view of the alleged Excise offences.
  • Whether ownership of the vehicle used in the alleged liquor seizure justifies denial of bail.
  • Whether the petitioner’s clean antecedent and gender are relevant factors for granting anticipatory bail.

seized vehicle. It is next submitted that no prudent person would

use her own vehicle for committing a crime and thus, would

create evidence against herself and hence, would get implicated.

It is further submitted that petitioner was completely unaware

          from the place of occurrence.

                       5. Learned A.P.P. opposes the anticipatory bail

accepting the provisional bail bonds of the petitioner shall verify
