Holding

The court allowed the anticipatory bail, granting provisional bail subject to conditions and verification of antecedents.

Summary

The petitioner, Mannu @ Abhimanyu Kumar Paswan, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case under Section 30(a) of the Excise Act alleging recovery of 13.58 litres of liquor from his house. The petitioner argued that the liquor was not found in his conscious possession, the house is a joint family property, and the amendment to the Excise Act in 2018 has abolished the concepts of deemed possession and presumed offender. The State opposed the bail. The High Court, considering these submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs.45,000 with two sureties, subject to verification of his criminal antecedents. The court clarified that if the petitioner is found to have more than nine prior cases, the bail may be revoked, otherwise it will be confirmed.

Issues considered

  • Whether anticipatory bail should be granted when liquor is not recovered from the accused's conscious possession under Section 30(a) of the Excise Act.
  • Effect of the 2018 amendment to the Excise Act removing deemed possession on the grant of bail.
  • Impact of the petitioner’s criminal antecedent (nine prior cases) on the anticipatory bail order.

                                2. The petitioner seeks bail in anticipation of his

                                3. The learned counsel for the petitioner submits that

the petitioner has antecedent of nine cases out of which seven

cases are under the Excise Act and allegation is of recovery of

                                4. The learned counsel for the petitioner submits that

petitioner was not arrested from the spot, as such, nothing was

with certainty that it was the petitioner, who had kept the liquor

in the house or the liquor kept in the house was within his

knowledge and after Amendment in the Excise Act, 2018, the

concept of deemed possession and presumed offender has been

done away with. It is also asserted and submitted that liquor was

not recovered from the house but adjacent to the house and he

came to be implicated based on secret information, which is the

easiest way to implicate someone. It is next submitted that

confessional statement in a mechanical manner without holding

          application.

                       6. Considering the submissions made by the learned

connection with Patna Kotwali P. S. Case No.128 of 2026,

subject to the conditions laid down under Section 438(2) of the

                         Cr.P.C.

                                      7. The application stands allowed.

                                      8. It is made clear that the learned trial Court after

accepting the provisional bail bonds of the petitioner shall verify

the criminal antecedent of the petitioner and in the event, if it is

found that petitioner has antecedent of more than nine cases,

then it would be presumed that petitioner for the purposes of

obtaining anticipatory bail had concealed his antecedent before

this Court, in that event, the present provisional anticipatory bail

order shall not be confirmed, but if on verification, it is found

that petitioner has antecedent of nine cases only, in that event,

the provisional anticipatory bail order shall be confirmed

                         forthwith.
