The Court granted provisional anticipatory bail to the petitioner, subject to bond and verification of antecedent.

Summary

Lalan Yadav applied for anticipatory bail in a case registered under Section 30(a) of the Excise Act for the alleged recovery of 123.75 litres of liquor from a straw house on his premises. He asserted that he has a clean antecedent, that the liquor was not in his conscious possession, and that the straw house is accessible to villagers, suggesting he was unaware of the liquor’s presence. The State opposed the bail, arguing the seriousness of the offence. The Court, after considering the petitioner's clean record and the circumstances of the alleged recovery, granted provisional anticipatory bail subject to a bond of Rs.500 with two sureties and conditions under Section 438(2) of the Cr.P.C. The trial court was directed to verify the petitioner’s antecedent before confirming the bail.

Issues considered

  • Whether anticipatory bail should be granted under Section 438 Cr.P.C. for an offence under Section 30(a) of the Excise Act.
  • Whether the absence of liquor in the petitioner’s conscious possession and the nature of the straw house justify bail.

                                      8. It is made clear that the learned trial Court after

accepting the provisional bail bonds of the petitioner shall verify

found that petitioner has antecedent of even one case, then it

would be presumed that petitioner for the purposes of obtaining

petitioner is a person with clean antecedent, in that event, the

provisional anticipatory bail order shall be confirmed forthwith.
