Provisional anticipatory bail is granted to the petitioner, subject to verification of his antecedent and compliance with the stipulated conditions.

Summary

The petitioner, Kunal Sahani, feared arrest in a case under Section 30(a) of the Bihar Excise Act alleging recovery of 20.7 litres of liquor from his joint family house and that of Gautam Sahni. He argued he had no conscious possession, the house being joint family property, and that the 2018 amendment had abolished the concept of deemed possession and presumed offender. The State opposed his request for anticipatory bail. The High Court, considering these submissions, granted provisional anticipatory bail subject to a bail bond of Rs. 500 with two sureties and a condition that the trial court verify his criminal antecedent within six weeks. If any antecedent is found, the bail may be cancelled; if he is found to have a clean record, the provisional bail will be confirmed. The petitioner also undertook to deposit Rs. 1,500 with the Advocates’ Association.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 30(a) of the Bihar Excise Act.
  • Whether the amendment removing deemed possession affects the applicability of anticipatory bail.
  • Whether the joint family nature of the property precludes attribution of possession to the petitioner.

                             3. Learned counsel for the petitioner submits that the

petitioner is a person with clean antecedent and allegation is of

such it cannot be alleged with certainty that it was petitioner

who had kept the liquor in the house or the liquor kept in the

house was within knowledge of the petitioner. It is further

submitted that he came to be implicated based on secret

information which is the easiest way to implicate someone.

                   5. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

                   6. Considering the submissions made by the learned
