The Court allowed the anticipatory bail application, subject to a bail bond, sureties, and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Pawan Mahto, applied for anticipatory bail under Section 438(2) of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 300 litres of liquor from a bamboo orchard adjacent to his house. The petitioner argued that the liquor was not recovered from his conscious possession, the location did not belong to him, and the FIR omitted the name of the informant, casting doubt on the prosecution's case. The State opposed the anticipatory bail, citing the petitioner’s antecedent of ten prior cases, eight of which were under the Excise Act. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.50,000 with two sureties and directed verification of the petitioner’s criminal antecedent. The order further stipulated that if the petitioner is found to have more than ten prior cases, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted under Section 438(2) CrPC for offences under Section 30(a) of the Excise Act despite the petitioner’s prior criminal antecedents.
  • Whether the absence of recovery from the petitioner’s conscious possession and the location of the alleged liquor affect the grant of anticipatory bail.
  • What conditions may be imposed under Section 438(2) CrPC when granting anticipatory bail.

recovery is from a place, which does not belong to the

petitioner, but then, is adjacent to his house and he came to be

implicated at the instance of local person, but the name of the

                                      8. It is made clear that the learned trial Court after

accepting the provisional bail bonds of the petitioner shall verify

found that petitioner has antecedent of more than ten cases, then

it would be presumed that petitioner for the purposes of

that petitioner has antecedent of ten cases only, in that event, the

provisional anticipatory bail order shall be confirmed forthwith.
