Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner subject to conditions.

Summary

The petitioner, Md. Danish, was accused under Sections 69 and 89 of the Bharatiya Nyaya Sanhita for allegedly entering a relationship under false pretence, refusing to marry the informant after she became pregnant, and providing abortion pills. The prosecution’s case was based on the informant’s claim that the petitioner induced the pregnancy and acted coercively. The petitioner contended that the relationship was consensual, the informant was an adult and divorced, and that the FIR was fabricated. He applied for anticipatory bail, arguing clean antecedents and lack of any coercion or false promise. The court, after considering the nature of the allegations and the petitioner’s clean record, granted anticipatory bail subject to a bond of Rs.10,000 with two sureties and compliance with Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner accused under Sections 69 and 89 of the Bharatiya Nyaya Sanhita
  • Whether the alleged acts constitute a false or coerced sexual offence or a consensual relationship
