Patna High Court

Manish Bind @ Manish KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to bond and surety conditions, under Section 482(2) of the BNSS.

Summary

Manish Bind, a 22‑year‑old with no prior record, was named in an FIR alleging extortion and several other offences under the Bharatiya Nyaya Sanhita. He contends that the allegations arise from a commercial dispute and that he was falsely implicated, noting that the FIR does not specifically charge him. The petitioner sought anticipatory bail, arguing that his arrest would be unwarranted and that the case does not merit such severe charges. The State opposed the bail, maintaining that the offences listed are serious and that the petitioner should be detained. The Court, after considering the submissions, granted anticipatory bail subject to a Rs.10,000 bond, two sureties, and compliance with conditions under Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the Bharatiya Nyaya Sanhita in view of the allegations of extortion and related offences
  • Whether the petitioner has been falsely implicated and thus merits bail despite the seriousness of the charges

rather there was a dispute with regard to payment since

informant runs a grocery shop on account of which an

altercation took place in which both sides assaulted each other.

It is next submitted that from perusal of the allegations as

alleged in the FIR, it would manifest that no specific allegation

is alleged against the petitioner. It is also submitted that Triloki

Bind had approached this Court seeking anticipatory bail by

filing Cr. Misc No. 36926 of 2025 and the same came to be

allowed by an order dated 18-6-2025 by a learned Co-ordinate
