The court granted provisional anticipatory bail, subject to bond, sureties, and verification of the petitioner’s criminal antecedent.

Summary

Rahul Kumar applied for anticipatory bail under Section 438 of the Cr.P.C. in a case registered under Section 30(a) of the Excise Act for alleged recovery of 180 litres of liquor. He argued that he was not arrested at the spot, no liquor was found in his conscious possession, and the allegation stemmed from a watchman's (chaukidar's) information, suggesting a lack of substantive evidence. The State opposed the bail, citing his two prior cases under the Excise Act. The High Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to verification of his criminal antecedent. The court stipulated that if more than two prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith. The application for anticipatory bail was allowed.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 Cr.P.C. in a case involving alleged offences under Section 30(a) of the Excise Act.
  • Whether the petitioner’s prior criminal antecedent of two cases affects the grant of anticipatory bail.

the criminal antecedent of the petitioner and in the event, if it is

found that petitioner has antecedent of more than two cases,

then it would be presumed that petitioner for the purposes of
