Patna High Court

Sikendra Nut @ Sikandar NatversusThe State of Bihar

Decided

DISPOSED

Holding

The court granted provisional anticipatory bail subject to conditions and verification of the petitioner’s antecedent.

Summary

The petitioner, Sikendra Nut, sought anticipatory bail in a case registered under Section 30(a) of the Bihar Excise Act for alleged recovery of 105 litres of liquor. He argued that the liquor was seized from a location not belonging to him and that he was implicated at the behest of a hostile chowkidar, with no material recovered from his possession. The State opposed the bail, citing the petitioner’s antecedent of five prior cases, four of which were also under the Excise Act. The High Court, considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs. 25,000 with two sureties and subject to verification of his criminal antecedents under Section 482(2) of the BNSS. The order stipulated that if more than five prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Excise Act given the petitioner’s criminal antecedent.
  • Whether the alleged recovery of liquor from a place not owned by the petitioner affects the grant of anticipatory bail.
  • Whether the High Court may impose conditions under Section 482(2) of the BNSS pending verification of antecedents.
