The Court allowed the anticipatory bail application, granting provisional bail subject to verification of the petitioner’s criminal antecedents.

Summary

The petitioner, Pawan Kumar, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 300 litres of liquor near the Punpun river. He contended that he was not arrested at the spot, that no liquor was found in his possession, and that the alleged recovery occurred on public land based on secret information, suggesting a possible false implication. The State opposed the bail, emphasizing the seriousness of the offence and the petitioner’s prior criminal record comprising four cases, three of which are under the Excise Act. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.20,000 with two sureties, subject to verification of his criminal antecedents. It further stipulated that if the verification reveals more than four prior cases, the provisional bail would not be confirmed; otherwise, it would be confirmed forthwith. The application was therefore allowed, granting provisional anticipatory bail with conditions.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 CrPC in a case under Section 30(a) of the Excise Act.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
