Provisional anticipatory bail is granted subject to verification of the petitioner’s antecedent and compliance with the conditions imposed under Section 482(2) of the BNSS.

Summary

The petitioner, Arvind Sahani, was implicated in a case under Section 30(a) of the Bihar Excise Act for the alleged recovery of ten litres of liquor from his residence, which is a joint family property. He asserted that he had no conscious possession of the liquor and possessed a clean criminal antecedent. The State opposed his application for anticipatory bail. The Court, considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs. 500 with two sureties and conditioned the order on verification of the petitioner’s antecedent by the trial court. If any prior case is found, the bail may be revoked; otherwise, the provisional order will be confirmed. The order was made under Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Excise Act where the alleged liquor is found in a joint family house and the accused claims no conscious possession.
  • Whether the amendment removing the concept of deemed possession affects the bail application.
  • Whether the trial court can verify the petitioner’s antecedent before confirming anticipatory bail under Section 482(2) of the BNSS.

                   Bihar Excise Act.

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

2018, the concept of deemed possession and presumed offender

has been done away with and he came to be implicated at the

appear probable that local person would have known who had

concealed the liquor in the house.

                       5. Learned A.P.P. for the State opposes the prayer for

shall verify the criminal antecedent of the petitioner and in the
