The court allowed the anticipatory bail application, granting provisional bail subject to verification of the petitioner’s antecedent.

Summary

Gautam Kumar, the owner of a motorcycle from which 39.375 litres of liquor was recovered, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with offences under Sections 30(a) and 32(3) of the Excise Act. He contended that he had a clean antecedent, was not in possession of the liquor at the time of seizure, and was unaware that the vehicle would be misused. The State opposed the bail, arguing the seriousness of the excise offences. The High Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 each with two sureties, and conditioned the order on verification of his antecedent. The court further stipulated that if any prior case is discovered, the provisional bail would not be confirmed, whereas a clean record would lead to immediate confirmation. The application was therefore allowed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC in view of the alleged excise offences.
  • Whether the petitioner’s ownership of the vehicle implicates him in the commission of the offences.

                                2. The petitioner seeks bail in anticipation of his

                                3. The learned counsel for the petitioner submits that

the petitioner is a person with clean antecedent and allegation is

petitioner was not arrested from the spot, as such, nothing was

recovered from his conscious possession and he came to be

implicated based on the fact that he is owner of the seized

vehicle. It is next submitted that no prudent person would use

his own vehicle for committing a crime and thus, would create

evidence against himself and hence, would get implicated. It is

further submitted that petitioner was completely unaware that

                       7. The application stands allowed.

                       8. It is made clear that the learned trial Court after
