The application for anticipatory bail is allowed, granting provisional bail subject to conditions and verification of antecedent.

Summary

The petitioner, Krishna Choudhary, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 31 litres of liquor. He argued that he has a clean antecedent, that the alleged liquor was recovered from a place not belonging to him, and that the only evidence against him is a confessional statement made by his brother while in police custody, which he contended lacks evidentiary value. The State opposed the anticipatory bail. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to verification of his criminal antecedent and compliance with Section 438(2) CrPC conditions. The order also required the petitioner to deposit Rs.1,500 with the Lawyers’ Association, Patna High Court, and stipulated that if any antecedent is discovered, the bail would not be confirmed.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Excise Act.
  • Whether a confessional statement made by a co-accused in police custody is admissible for granting bail.
  • Whether the petitioner’s clean antecedent warrants provisional anticipatory bail.
