The Court allowed the anticipatory bail application, granting provisional bail subject to conditions and verification of antecedents.

Summary

The petitioner, Dhiraj Kumar, applied for anticipatory bail under Section 438(2) of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 5.46 litres of liquor from a field adjacent to his house. The petitioner argued that the liquor was not in his conscious possession, the alleged recovery site did not belong to him, and the complaint was filed by a hostile watchman, raising doubts about the prosecution's case. The State opposed the anticipatory bail. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.10,000 with two sureties, subject to verification of his criminal antecedent. The order stipulated that if more than two prior cases are found, the bail would not be confirmed; if only two are found, the bail would be confirmed. The application was allowed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438(2) CrPC in a case under Section 30(a) of the Excise Act.
  • Whether the alleged recovery of liquor constitutes possession sufficient to deny bail.
  • Whether the petitioner's criminal antecedent warrants denial of anticipatory bail.

                                3. The learned counsel for the petitioner submits that

the petitioner has antecedent of two cases and allegation is of

petitioner was not arrested from the spot, as such, nothing was

inimical term. It is further submitted that if Chaukidar was

aware of the involvement of the petitioners in the occurrence,
