Holding
The Court conditionally granted provisional anticipatory bail, subject to bond, sureties, and verification of the petitioner’s criminal antecedent.
Summary
The petitioner, Upendra Kumar, feared arrest in a case under Section 30(a) of the Bihar Excise Act alleging recovery of 400 litres of liquor from two motorcycles. He was not caught in possession and was implicated solely on a confessional statement made by a co-accused in police custody, which the petitioner argued lacked evidentiary value. The State opposed his prayer for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bond of Rs. 35,000 with two sureties and directed verification of the petitioner’s criminal antecedent. If the petitioner is found to have more than seven prior cases, the bail will not be confirmed; if exactly seven, the provisional bail will be confirmed. The order was made under Section 482(2) of the BNSS.
Issues considered
- What is the appropriateness of granting anticipatory bail when the only evidence is a confessional statement made in police custody?
- Does the petitioner’s prior criminal antecedent affect the grant of anticipatory bail under Section 482(2) of the BNSS?
