The Court granted provisional anticipatory bail to the petitioner, subject to verification of his antecedent and compliance with the stipulated conditions.

Summary

The petitioner, Aditya Kumar, sought anticipatory bail after liquor amounting to 302,400 liters was recovered from two Mahindra XUV500 vehicles he owned. He argued that he was not in possession of the liquor, had no knowledge of his cousin Arun's alleged misuse of the vehicles, and possessed a clean criminal record. The State opposed the bail, contending the offences under Sections 30(a), 32(i)(iii) and 41(i)&(ii) of the Bihar Excise Act. The High Court, considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and directed verification of the petitioner’s antecedent. The order stipulated that if any prior case is discovered, the bail would be revoked, otherwise it would be confirmed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the BNSS in view of the alleged offences under the Bihar Excise Act.
  • Whether the petitioner’s lack of possession and alleged ignorance of the misuse of his vehicle justify bail.
